The UCL Institute of Brand and Innovation Law chaired by Sir Robin Jacob organised a forum discussion on the topic: EPO and UPC: Friends or Foes?
The panel consisted of:
Dr Ingo Beckedorf (Chairman of Legal Board of Appeal, EPO)
Florence Butin (President of CFI of UPC)
Edward Oates (partner at Carpmaels and Ransford LLP)
Annsley Merelle Ward (partner at Wilmer Hale)
Chair: Professor Sir Robin Jacob (UCL Faculty of Laws and Director of the UCL Institute of Brand and Innovation Law)
I booked a ticket to follow the discussion on line.
The patent relates to improvements insecurity substrates for security documents.
Brief outline of the case
The OD decided that claim 1 as granted was lacking N over D1=WO2004/056582 not mentioned in the ISR established by the EPO.
The patent was maintained according to AR6.
Both the opponent and the proprietor appealed the OD’s decision.
The patent relates to a grain-oriented electrical steel sheet having excellent magnetic characteristics and coating adhesion.
Claim 1 as granted comprised a coating layer A on the steel side and a coating layer B formed on a surface side mainly composed of glass.
Dependent claim 4 mentioned the following parameter: “a coating weight of the coating layer A on the steel sheet side is 1.0-3.0 g/m2 (both sides) as converted to oxygen”
On 25.05.2023, I had the opportunity to follow online a conference/discussion organised and hosted by the Department for IP of the University of Osnabruck.
Introduction to the event
Since the publication of the Patent Quality Charter by the European Patent Office (EPO), a lively discussion has flared up whether the EPO is setting the right priorities in improving processes and accurately assesses the interests of the stakeholders.
